12345 Boom is an AI-powered fitness training application that provides:

  • Personalized training plans for running, cycling, and multisport activities
  • Adaptive workout scheduling based on completed activities
  • Integration with third-party fitness platforms (Strava, Garmin, Wahoo)
  • Progress tracking and fitness analytics
  • Weather-aware workout recommendations

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

You must be at least 13 years old to create an account. Users under 18 should have parental consent.

4. Subscriptions and Payments

4.1 Free Trial

We may offer a free trial period. At the end of the trial, you will be charged unless you cancel before the trial ends.

4.2 Subscription Plans

Premium features require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan.

4.3 Automatic Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your App Store or Google Play account settings.

4.4 Refunds

Refunds are handled by the respective app stores (Apple App Store, Google Play) according to their policies.

5. Acceptable Use

You agree not to:

  • Interfere with or disrupt the Service or servers
  • Reverse engineer or attempt to extract source code
  • Use automated systems to access the Service without permission
  • Share your account credentials with others

6. Health and Fitness Disclaimer

IMPORTANT: Please read this section carefully.

The Service provides general fitness information and training suggestions. It is NOT a substitute for professional medical advice, diagnosis, or treatment.

  • Consult a physician before starting any exercise program
  • Stop exercising immediately if you experience pain, dizziness, or discomfort
  • The AI-generated plans are suggestions, not medical prescriptions
  • You are responsible for determining your own physical capabilities
  • We are not liable for any injuries resulting from following workout suggestions

By using the Service, you acknowledge that physical exercise involves inherent risks and you assume full responsibility for your participation.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by 12345 Boom and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you provide. By using the Service, you grant us a license to use your data to provide and improve the Service.

8. Third-Party Services

The Service may integrate with third-party services (Strava, Garmin, Wahoo, etc.). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 12345 BOOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Personal injury or property damage
  • Any damages arising from your use of the Service

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

You may delete your account at any time through the app settings or by contacting support.

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the app or via email. Your continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.
